Please read these Terms of Use carefully before using the Power MH website or services. By accessing our website or applying for membership, you agree to be bound by these terms.
These Terms of Use ("Terms") govern your access to and use of the Power MH website (the "Site") and services provided by Power MH ("Power MH," "we," "us," or "our"). By accessing or using our Site or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or services.
Power MH is a private, telehealth-based concierge psychiatric practice that offers membership-based psychiatric care to adult patients. Our services include psychiatric evaluation, medication management, and ongoing psychiatric care delivered via secure telehealth platforms.
The information on this Site is provided for general informational purposes only and does not constitute medical advice. A provider-patient relationship is established only upon execution of a membership agreement and completion of an onboarding evaluation.
To use our services, you must:
Power MH reserves the right to decline any application or terminate any membership at our sole discretion, including for clinical or safety reasons.
Power MH is not an emergency service. If you are experiencing a psychiatric emergency, are in immediate danger, or are having thoughts of harming yourself or others, call 911, go to your nearest emergency room, or call or text 988 (Suicide & Crisis Lifeline) immediately.
Power MH providers cannot guarantee real-time availability outside of scheduled appointment times. Members with urgent safety concerns should always contact emergency services first.
Upon acceptance into Power MH, you will receive and must execute a Membership Agreement that governs the specific terms of your care, including appointment cadence, communication protocols, minimum commitment periods, and cancellation terms. These Terms of Use operate alongside, and do not replace, your Membership Agreement.
Membership tiers may include minimum commitment periods as specified in your Membership Agreement. Early cancellation may result in fees as outlined therein. After any minimum commitment period, memberships may be cancelled with advance written notice as specified in your agreement.
Power MH provides adult psychiatric care only. Services do not include therapy, counseling, or psychology services. Power MH providers may refer members to additional mental health resources as clinically appropriate.
Power MH does not accept health insurance, Medicare, Medicaid, or any government-sponsored health program. All fees are the sole responsibility of the member. We do not submit claims to any insurance entity on your behalf.
Psychiatric services may be eligible for reimbursement through Health Savings Accounts (HSA) or Flexible Spending Accounts (FSA). Members are responsible for confirming eligibility with their plan administrator. Power MH does not guarantee HSA/FSA eligibility.
Payments are processed via secure third-party payment processors. By providing payment information, you authorize Power MH to charge your payment method for fees as outlined in your Membership Agreement.
Refund eligibility is governed by the terms of your individual Membership Agreement. All disputes regarding billing should be directed to billing@powermh.com.
By participating in telehealth services with Power MH, you acknowledge and agree that:
A formal Telehealth Informed Consent form will be provided as part of your onboarding and must be executed before services begin.

All content on the Power MH website — including text, design, graphics, logos, and copy — is the property of Power MH and is protected by applicable copyright, trademark, and intellectual property laws. No content may be reproduced, republished, or distributed without prior written consent from Power MH.
The Power MH website and its content are provided on an "as is" basis without warranties of any kind, express or implied. Power MH does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing on this Site constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any medical or psychiatric concerns. Do not disregard professional medical advice or delay seeking it because of something you have read on this Site.
To the maximum extent permitted by applicable law, Power MH and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Site or services — including damages for loss of data, revenue, goodwill, or other intangible losses — even if advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to Power MH in the three months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of our services shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action proceeding.
Power MH reserves the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Continued use of our Site or services after changes are posted constitutes your acceptance of the updated Terms. Material changes will be communicated to active members via the email address on file.
